REGARDING THESE TERMS AND CONDITIONS OF SALE
The following terms and conditions of sale (the “Terms of Sale”) will apply to all purchases made through the website www.ramo2.it (the “Website”). The Website and the goods provided through it are supplied by Ramo 2 S.r.l., a company duly incorporated in Italy, with VAT ID 04013970126, registered in the Business Register of Varese and with its registered office at Via Carlo Robbioni, 2 21100 Varese (VA), Italy (hereinafter referred to as “We”, “Us”, and “Our”). When we use “You” and “Your,” we refer to you, the user of the Website and purchaser of the goods. Purchasing items through our Website implies knowledge and acceptance of our Terms and Conditions of Use, Shipping Information, Return Policy and right of withdrawal, Warranty, and Privacy. By accepting these Terms of Sale, you also accept the supplementary Policies, which together constitute a legally binding part of the contract between us and the user. We invite the User to read these Terms of Sale and the supplementary Policies carefully before proceeding with the purchase of any item from the Website. Ramo 2 S.r.l. reserves the right to modify the Terms of Sale and supplementary Policies at any time. Any modification to the Terms of Sale or the supplementary Policies will be valid for all new orders placed after the publication of the modification on the Website. The User is invited to consult the Terms of Sale and supplementary Policies published on the Website before each order, to evaluate and accept the changes that have occurred since their last access. In case of questions or requests regarding the Terms of Sale, supplementary Policies, goods, or the Website, please contact us by email at contact@ramo2.it. Any variation of these Terms of Sale requires our written confirmation. Please note that the Terms of Sale and supplementary Policies do not prejudice or limit the User's rights as a consumer, in accordance with all consumer protection laws applicable in their country.
PART A – INFORMATION ABOUT THE WEBSITE AND THE GOODS
This PART A provides some important information about the Website and the goods sold through the site.
INFORMATION PROVIDED ON THE WEBSITE
We strive to ensure that all information on the Website, including descriptions of our goods and the prices listed, are accurate and exact at all times. However, errors can occur. We will attempt to correct any errors in the information on the Website as soon as reasonably possible and, if we believe that such errors may have affected the User's order, we will make every reasonable effort to notify them using the contact information provided in their account or during the order. Purchasing products on the Internet provides a different shopping experience from buying in-store. In particular, the User should be aware that:
- the colors of items as shown on the Website depend on many factors, including display settings;
- the actual sizes and shapes of the items may differ from how they appear on the screen. Please note that all the relevant technical information for each item for sale on the Website is provided;
- photos and images on the Website are for illustration purposes only. For an accurate description of each item and details of what is included with it, please refer to the corresponding written description.
- all goods are subject to availability, and we may not be able to fulfill the order placed. We reserve the right to withdraw any product from sale at any time;
- we will do our best to arrange the delivery of the item(s) within reasonable times from the order, in accordance with applicable legal standards, as well as these Terms of Sale. However, it should be noted that we receive all tracking information from our shipping service provider, and it is only an estimated delivery time. Actual delivery dates may vary. Further delivery details will be available on the tracking website of our shipping service provider. Please see PART B below for more information on delivery;
- we reserve the right to adjust prices, items, and special offers at our discretion on the Website, in accordance with all applicable laws and regulations. Such changes will not affect orders already placed, even before our acceptance.
- We will do our best to perform antivirus checks on the Website but do not guarantee that it is free from viruses or other harmful content for the personal computer, tablet, smartphone, or other devices used by the User. For their part, the User must ensure they have adequate software and systems installed for antivirus and other harmful content checks on the Internet. This does not prejudice the conditions stated in the Terms and Conditions of Use.
AVAILABILITY
We have the right at any time to modify or discontinue the supply of the Website as well as the right to discontinue the sale of one or all of the items through it, either temporarily or permanently, with or without notice. We will not be liable to the User for any modification, suspension, or discontinuation of the availability of the Website.
SECURITY
It is the User's responsibility to ensure that any access data or passwords and any other details related to their account remain confidential at all times. The User agrees to notify us as soon as possible if they become aware or reasonably suspect that the security of their account is at risk. We remind the User that, without prejudice to the terms of the Privacy Policy, at the time of registration on this Website, they will be asked to provide complete, up-to-date, and true information, as it is expressly prohibited to use names, credentials, or profiles that do not match the personal identity of the User.
PART B – PURCHASE OF GOODS
This PART B establishes the terms applicable to the purchase of goods from the Website by the User.
PLACING AN ORDER
Once the items they wish to purchase are selected, the User will be asked to register with their personal details by completing a registration form. Registration is not mandatory; however, we promote registration to facilitate the purchasing procedure during future orders on the Website. The User will always have the opportunity to complete their orders as a “guest” without any registration on the Website. The User will also be required to provide their debit or credit card details to allow us to receive payment after accepting the order. The presentation of the item(s) on the Website and the request to provide such data and information do not constitute a contractual obligation for Ramo 2 S.r.l. to supply the goods until the order has been fully accepted, according to the following terms. To verify that the User's details are correct and to manage payment on our behalf, Ramo 2 S.r.l. uses an external third-party service provider to process the payment. The User's personal data, including credit card details, will be transferred and held by such third-party payment processor or by those other parties we may use to perform anti-fraud checks. We do not hold credit or debit card data. By placing the order, the User expressly consents to the transfer of their data for this purpose. Such data will be processed in accordance with the terms of the Privacy Policy without prejudice to all other legal provisions applicable in their country of residence. Should we encounter any inaccuracies during the verification of the data or a discrepancy in the credit or debit card information, the purchasing procedure may be delayed, suspended, or interrupted. After placing an order through the dedicated section of our Website, the User will be able to access a confirmation page, which summarizes their order, and will receive an email confirming the order (collectively the “Order Confirmations”). The User must carefully check all the data and information indicated in the Order Confirmations, ensuring they correspond to their intentions. They may make additions or changes to their order after sending the Order Confirmations for one hour after such Confirmations by contacting our Customer Service. The Order Confirmations contain the details of the ordered items, the total cost of the order, including delivery, and an order number. The Order Confirmations represent the User's commitment to purchase the goods and an authorization to charge the corresponding price on the credit or debit card, subject to confirmation and acceptance of the order by Ramo 2 S.r.l.
ORDER ACCEPTANCE
All orders summarized in the Order Confirmations are subject to acceptance by Ramo 2 S.r.l., which reserves the right to accept the order concerning all or only part of the items indicated in the Order Confirmations. The acceptance of the order will be communicated to the User through the sending of an email with the contract confirmation and the subsequent shipment of the purchased items (the “Shipping Confirmation”). The contract between the User and Ramo 2 S.r.l. will thus be considered in force from the date of the Shipping Confirmation email and will refer exclusively to the items listed in it. The Shipping Confirmation will include the purchase receipt and will precisely indicate the VAT paid for such transaction. The receipt will be valid as proof of purchase of the items and may be retrieved on the Website at any time in the “Order History” section. We strongly recommend printing a copy of the receipt, along with a copy of these Terms of Sale and the supplementary Policies, and keeping them carefully. If it is necessary to contact us regarding the order made, it may be necessary to expressly refer to such documents. Although we hope to be able to provide all the ordered goods, we reserve the right, at our discretion and without the need to provide any justification, not to accept any offer at any time before the related goods have been shipped. In the event of refusal of the order, this will be communicated to the User as soon as reasonably possible.
PAYMENT
We will charge the payment on the User's credit or debit card at the time they receive the Order Confirmation via email, which will specify which items of the order have been purchased and the shipping cost of the same (the "Email"). We will contact the User in case of problems in collecting the payment through the details provided during the order procedure. If the payment should fail or not be made, Ramo 2 S.r.l. is released from the delivery of the item(s), without prejudice to every other remedy and right. All prices indicated on the Website are inclusive of VAT and other applicable taxes. Without prejudice to the specific terms relating to the delivery of items stated in the Shipping Information, we do not charge the User any fee for shipping the items to their shipping address. Except as otherwise established in these Terms of Sale, the price to be paid for the goods is the price indicated in the relevant Order Confirmations at the time of the order.
PRICE ERRORS
Although we strive to ensure that all prices listed on the Website are accurate, errors can occur. If, before our acceptance of the order as indicated by the Shipping Confirmation, we detect an error in the price of the ordered goods, we will inform the User as soon as reasonably possible, except as otherwise established according to the consumer protection law applicable. The User will then have the opportunity to reconfirm their order at the correct price or to cancel it. If we are unable to contact the User through the contact details provided during the order procedure, we will consider the order canceled and will notify them by email. This does not prejudice all the rights and provisions applicable to the User as a consumer, in accordance with any consumer protection law applicable.
DELIVERY
Shipping Confirmations will include general information about the order as well as an estimated delivery date for the goods. The Email will include such estimated delivery date and a tracking number that the User may use to track their order on our delivery service provider's website and confirm the time of delivery of the item. Delivery will be made to the shipping address within the territory covered by this Website as specified by the User during the ordering process.
Regarding all items sold through the Website www.ramo2.it, the cost of shipping and delivery varies based on the destination location specified by the User. The applicable rate will be calculated and displayed in the order summary at the time of check-out, before the User proceeds to confirm the payment.
For Orders, we estimate a delivery time of approximately 3-5 business days from the date of the Shipping Confirmation (hereinafter, the “Shipping Day”). In any case, orders will be delivered at the latest within 30 days from the Shipping Day or, if shorter, within the maximum delivery period provided by the laws and regulations applicable in the User's country of residence. In the Shipping Confirmation, we will confirm the courier details and the tracking number as soon as the order is shipped. The User will be able to track the shipping status of their order at any time through the "My Account" page on www.ramo2.it.
For any request regarding delivery, please contact us at the following address: contact@ramo2.it. Once the goods have been delivered to the User and the User has acquired physical possession of them, the User becomes the owner of such goods and from that moment on any risk of loss, theft, or damage shall be at their expense, in accordance with any applicable law and regulation. Upon delivery, the User must verify the condition of the order and whether they have received the exact number of items. Missing items will be reordered and damaged/incorrect ones will be returned and, based on these Conditions of Sale, replaced and delivered free of charge. The User must notify us of the presence of any damaged, missing, and/or incorrect product in accordance with the Warranty under Part D of these Conditions of Sale.
PART C – CANCELLATION OF THE ORDER AND RETURN OF THE GOODS
Right of withdrawal: We provide the right to withdraw from the contract for any reason within a return period of 30 days from the date of purchase, allowing the User to cancel their contract within 10 days from the acquisition of the item(s). The right of withdrawal may be exercised in relation to one or more delivered items, except for personalized items. In case of withdrawal and return of the items, the User is required to take reasonable care of the items and return all unwanted products at their expense. We invite the User to read our Return Policy for more information on the 30-day return period and the return of the goods. Please note that this 30-day return period allows the User to have a longer evaluation period of the purchase compared to the 14-day return period for exercising the right of withdrawal and return of the purchased products, typically guaranteed by Italian Law L. D. 206/2005, the European Consumer Protection Directive (Directive 2011/83/EU), and all consumer protection laws applicable in their country. Please refer to the “Return Policy” for specific terms and conditions applicable to your rights of withdrawal and refund. WARNING: spare parts cannot be returned, except when a non-conforming spare part has been received. The refund of products purchased by cash on delivery or bank transfer will be made with a voucher equal to the value of the products themselves.
Defective goods: If the User believes that the goods delivered are not materially in accordance with their description previously provided in the Order Confirmations, are incomplete or damaged or are defective and we cannot remedy the problem or defect to their reasonable satisfaction, then such goods may be returned without prejudice to the other rights guaranteed to them by applicable law. We invite the User to read our Return Policy and Warranty carefully for further information on the return of defective goods or those items purchased that do not correspond to what is described in the Order Confirmations and confirmed in the Shipping Confirmation.
PART D – GENERAL CONDITIONS OF OUR RELATIONSHIP WITH THE USER
SOLE FINAL USE
The goods sold on this Website are intended exclusively for the private final use of consumers and are not intended for resale or commercial distribution. The User declares to purchase the products as a consumer.
WARRANTY
The details of the User's warranty rights for each type of product are reported in our Warranty. Such warranties are additive and do not limit the User's rights recognized as a consumer, as provided by every law and regulation applicable in their country of residence.
FORCE MAJEURE
Ramo 2 S.r.l. will not be responsible for any delay or failure to perform the contractual obligations due to force majeure causes such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed times.
WAIVER
The delay in exercising or the non-exercise by us of any right or remedy under these Terms of Sale will not constitute a waiver of our rights and remedies under these Terms of Sale.
NULLITY
In the event that one or more provisions set forth in these Terms of Sale or the supplementary Policies are deemed invalid by the competent authority, the remaining provisions of the Terms of Sale and the supplementary Policies will remain in force to the extent possible, and the User will always be bound by them.
PRIVACY
The personal information, such as contact details that the User provides during the order procedure, will be stored and used in accordance with our Privacy Policy.
APPLICABLE LAW and DISPUTE RESOLUTION
Notwithstanding the application of mandatory European norms for consumer protection, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and Legislative Decree 9 April 2003, no. 70 (“Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce”). It is also informed that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the website http://ec.europa.eu/odr. For all disputes related to purchases and/or these General Conditions of Sale, the competent court will be the court of the place of domicile or residence of the consumer according to the applicable law or, at the choice of the consumer themselves, the Court of Varese, Italy.
